In 2020, Abhisht Kusum Gupta filed a petition challenging Section 3(3)(a)(iv) of the Uttar Pradesh Self-Financed Independent Schools (Fee Regulation) Act, 2018. He argued that this provision, which allows schools to charge a "composite fee," was unconstitutional as it allegedly violated Article 14 of the Constitution by being arbitrary and discriminatory. The Allahabad High Court, while acknowledging the petitioner's concerns, noted that Gupta had not provided sufficient details about his child's admission or the specific fee issues. The court granted him liberty to file a review petition with necessary amendments to seek further relief.

Additionally, Gupta was involved in a case concerning the non-refund of school fees during the COVID-19 pandemic. He filed a petition in the Supreme Court after the Allahabad High Court dismissed his earlier plea, seeking directions to private schools in Uttar Pradesh to refund fees collected during the pandemic period
